COMPLIANCE WITH APPLICABLE  FAR 21.303(H)

It should be noted that some but not all products illustrated in this web site are covered by STC/PMA.  Avion Research cannot supply any product that does not comply with the requirement put forth in FAR 21. 303(H).  Avion can supply product fabricated under PMA providing the Instructions for Alternate Eligibility listed below are understood.

Further, it is the responsibility of the owner/installer to ensure compliance with all relevant Federal Aviation Regulations and to return the certified aircraft to service, which requires, but is not limited to, an approved FAA 337.

Instructions for Alternate Eligibility

You have ordered a component manufactured under PMA. The PMA specifies particular installation eligibility.  Because of the technical requirements of FAA approval, the PMA may not specify all models on which the component is eligible to be installed.

Major repairs and alterations generally must be supported by approved data. Minor repairs and alterations may be approved under a method acceptable to the FAA.  Avion Research Corporation, Inc, makes no representation about whether installation of its product is a major or minor process.

If you intend to install this component on an aircraft for which the PMA does not list eligibility, then Avion Research Corporation, Inc. strongly recommends that you obtain FAA approval of the data underlying the installation. The most common way to do this is to obtain FAA field approval from an authorized FAA employee/designee who signs a FAA Form 337.

Owner/Operator Parts

The following affidavit must be completed, signed and returned to Avion Research Corporation as part of the purchase order.

I certify that I am the owner/operator of this aircraft. I further certify that the assembly I am ordering represents an owner-operator produced part under 14 C.F.R. para 21-303(b)(2) in that (check each box that applies- you must check at least one.)

 I intend to control the design of the assembly by providing Avion Research Corporation with design data from which to fabricate the assembly.  I have obtained approved design data by license with Trevor Burward-Hoy signed below, and have have supplemented this data by specifying the exact configuration I am requesting.  I understand that I am legally responsible for the design of this assembly. I expect Avion Research Corporation to follow the design data that I have provided for the fabrication of this assembly.

 I intend to exercise quality control oversight of the manufacturing process by performing an in process inspection of the assembly before it is finished/painted, and by performing final inspection of the assembly when it is complete. I understand that although the design of the assembly may have been subject of an FAA design approval. (Supplemental type certificate), the assembly is not manufactured under FAA production approval and that I am legally responsible for quality control and inspection of the assembly.
